Article 2 - Products
Glasskin Beauty is an online multi-brand shop for Korean cosmetics. It sells authentic products: genuine Korean skincare, bought from professional distributors based in the EU. The essential characteristics of each product are presented on its product page; photographs are not contractually binding.
Article 3 - Prices
Prices are stated inclusive of all taxes (VAT included), in the currency displayed on the website at the time of ordering (euro, pound sterling, Swiss franc or US dollar), excluding shipping costs, which are specified before the order is confirmed. For orders delivered outside the European Union, any customs duties and import taxes payable on arrival are not included (see Article 6). Glasskin Beauty reserves the right to change its prices at any time; products are invoiced on the basis of the price in force when the order is confirmed.
Article 4 - Orders
The order is confirmed when the customer confirms payment at the end of the ordering process. A confirmation e-mail is sent to the customer. Glasskin Beauty reserves the right to cancel or refuse any order from a customer with whom there is a dispute relating to the payment of a previous order.
Article 5 - Payment
Payment is made online, at the time of ordering, by the payment methods offered on the website (bank card and other secure methods via Shopify Payments). Payment is secured by SSL encryption.
Article 6 - Delivery
Glasskin Beauty delivers to France, Germany, Italy, Spain, the United Kingdom, the Netherlands, Belgium, Portugal, Switzerland and the United States. The shipping costs for each destination are set out in our Shipping Policy; the exact amount and the estimated delivery time are shown before the order is confirmed. Orders delivered to the United States are subject to US customs duties and import taxes, which are not included in the prices and are payable by the recipient. For orders delivered to the United Kingdom and Switzerland, duties and taxes may be payable on receipt, depending on the value of the order and the rules of the destination country.
Article 7 - Right of withdrawal and returns
In accordance with Articles L221-18 et seq. of the French Consumer Code, the customer has 14 days from receipt of the order to exercise the right of withdrawal, without having to give any reason. This right applies to every order, including where the product's carton box has been opened; in accordance with Article L221-28 (5°) of the same Code, it cannot be exercised for a sealed product that was unsealed after delivery and is not suitable for return for hygiene or health protection reasons. In the event of withdrawal, Glasskin Beauty refunds all sums paid, standard delivery costs included, no later than 14 days after being informed of the customer's decision; it may withhold the refund until the products have been received or proof of their dispatch has been supplied. The direct cost of returning the products is borne by the customer. In addition, Glasskin Beauty voluntarily accepts the return of unopened products up to 30 days after receipt. The full terms and the model withdrawal form are set out in our Returns and Refunds Policy.
Article 8 - Legal guarantees
Glasskin Beauty is bound by the legal guarantee of conformity (Articles L217-1 to L217-32 of the French Consumer Code) and the legal guarantee against hidden defects (Articles 1641 to 1649 of the French Civil Code), without prejudice to the right of withdrawal mentioned in Article 7. To make use of these guarantees, the customer contacts customer service via the Contact page or at contact@glasskin-beauty.com.
Legal guarantee of conformity and guarantee against hidden defects (statutory notice provided for in Article D211-2 of the French Consumer Code)
The consumer has a period of two years from delivery of the goods to obtain the application of the legal guarantee of conformity if a lack of conformity appears. During this period, the consumer only has to establish the existence of the lack of conformity and not the date on which it appeared.
Where the contract of sale provides for the continuous supply of digital content or a digital service for a period of more than two years, the legal guarantee applies to that digital content or digital service throughout the planned supply period. During this period, the consumer only has to establish the existence of the lack of conformity affecting the digital content or digital service and not the date on which it appeared.
The legal guarantee of conformity obliges the trader, where applicable, to supply all updates needed to keep the goods in conformity.
The legal guarantee of conformity entitles the consumer to have the goods repaired or replaced within thirty days of the request, free of charge and without major inconvenience.
If the goods are repaired under the legal guarantee of conformity, the consumer benefits from a six-month extension of the initial guarantee.
If the consumer asks for the goods to be repaired but the seller imposes a replacement, the legal guarantee of conformity is renewed for a period of two years from the date of replacement.
The consumer may obtain a reduction of the purchase price while keeping the goods, or terminate the contract and obtain a full refund in exchange for returning the goods, if:
1° the trader refuses to repair or replace the goods;
2° the repair or replacement takes place after a period of thirty days;
3° the repair or replacement causes major inconvenience to the consumer, in particular where the consumer definitively bears the costs of taking back or removing the non-conforming goods, or bears the costs of installing the repaired or replacement goods;
4° the lack of conformity persists despite the seller's unsuccessful attempt to bring the goods into conformity.
The consumer is also entitled to a price reduction or to termination of the contract where the lack of conformity is so serious that it justifies an immediate price reduction or termination. The consumer is then not required to ask first for the goods to be repaired or replaced.
The consumer is not entitled to terminate the sale if the lack of conformity is minor.
Any period during which the goods are out of use for repair or replacement suspends the remaining guarantee period until the repaired goods are delivered.
The rights mentioned above result from Articles L217-1 to L217-32 of the French Consumer Code.
A seller who obstructs in bad faith the application of the legal guarantee of conformity is liable to a civil fine of up to 300,000 euros, which may be increased to 10% of average annual turnover (Article L241-5 of the French Consumer Code).
The consumer also benefits from the legal guarantee against hidden defects under Articles 1641 to 1649 of the French Civil Code, for two years from discovery of the defect. This guarantee entitles the consumer to a price reduction if the goods are kept, or to a full refund in exchange for returning the goods.
Article 9 - Liability
Glasskin Beauty cannot be held liable for non-performance of the contract in the event of force majeure or misuse of the products by the customer outside the instructions for use indicated on each product page. If an ordered product turns out to be unavailable, the customer is informed without delay and refunded the sums paid for that product. In the event of an allergy or skin reaction, it is recommended to carry out a skin test before first use and to consult a healthcare professional in case of doubt.
Article 10 - Personal data
The processing of the customer's personal data is described in our Privacy Policy.
Article 11 - Applicable law and disputes
These GTCS are governed by French law. In the event of a dispute, the customer may make use of consumer mediation under the conditions specified in our Legal Notice, before taking any legal action. Failing an amicable resolution, the matter will be brought before the competent French courts, without prejudice to the protective provisions applicable to consumers residing in another Member State of the European Union.
Article 12 - Contact
For any questions regarding these GTCS, contact us via the Contact page or at contact@glasskin-beauty.com.
